Motion Creator is an online AI video generation service based on a prepaid credit system. Use of the Service implies full and unreserved acceptance of these Terms.

The User declares being at least 18 years old and having the legal capacity to contract. The User is responsible for keeping their credentials confidential and for all activity performed from their account. Novarys Systems reserves the right to suspend or close any account in case of breach of these Terms or of the Acceptable Use Policy.

The Service operates on the purchase of credit packs. Prices are displayed in euros, all taxes included (VAT applicable under French and European law). Payments are processed by a third-party provider (Stripe Payments Europe, Ltd.). Novarys Systems does not store any full payment card data.

Credits are personal, non-transferable, have no monetary value and are not refundable in cash. They remain valid for as long as the account is active. A generation that fails because of a technical defect of the Service is automatically refunded in credits to the User's account.

In accordance with article L221-28, 13° of the French Consumer Code, the User who is a consumer expressly acknowledges and accepts that the supply of digital content not provided on a tangible medium (credits and generated videos) starts immediately upon purchase, with their express and prior consent. As a result, the User expressly waives their right of withdrawal as soon as the credits are used.

As long as credits have not been used, the consumer User has a 14-day period from the date of purchase to exercise their right of withdrawal by email at support@motioncreator.studio.

The User retains ownership of the prompts and reference images they submit, provided they hold the corresponding rights. Subject to compliance with these Terms and the Acceptable Use Policy, the User is granted a license to use the generated videos for personal or commercial purposes.

The User is solely responsible for the content they submit and publish. As AI models may produce similar results for similar requests, no exclusivity is guaranteed on any given output.

The "Motion Creator" brand, logo, website, copy, interface and code are the exclusive property of Novarys Systems. Any unauthorized reproduction is prohibited.

The Service relies on third-party providers (AI models, payment, hosting). Their availability is beyond Novarys Systems' control, and their own terms apply to the features they power. The up-to-date list of subprocessors is available in the Privacy Policy.

The Service is provided "as is". Novarys Systems undertakes to use reasonable care in making the Service available but does not warrant uninterrupted availability, the absence of errors, or that generated content will meet any particular purpose.

To the extent permitted by applicable law, Novarys Systems shall not be liable for indirect damages (loss of revenue, loss of data, reputational harm). In any event, Novarys Systems' total liability is limited to the amounts actually paid by the User for the Service during the twelve (12) months preceding the triggering event. These Terms do not limit the statutory warranties of conformity and hidden defects provided under articles L217-3 et seq. of the French Consumer Code and 1641 et seq. of the French Civil Code.

Personal data processing is described in the Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act.

The User may close their account at any time from their profile or by email. Novarys Systems may suspend or close an account in the event of breach of these Terms, of the Acceptable Use Policy, or of applicable law. Credits unused at the closure date for a reason attributable to the User are forfeited.

Novarys Systems reserves the right to modify these Terms. Material changes are announced on this page and notified by email. The applicable Terms are those in force on the date the Service is used.

These Terms are governed by French law. In the event of a dispute, the User is invited to first contact Novarys Systems at support@motioncreator.studio in view of an amicable resolution.

In accordance with article L612-1 of the French Consumer Code, consumers may refer the dispute free of charge to a consumer mediator: [mediator name and contact details to be completed]. European online dispute resolution platform: ec.europa.eu/consumers/odr.

Failing amicable resolution, disputes shall be submitted to the courts having jurisdiction under common law rules.
